Five kinds of leverage AI cannot give your competitor

Patents, exclusive licences, trade secrets, proprietary data and regulatory approvals. What each one protects, how long it lasts, and when to use it.

Patents. A patent gives you a public, enforceable right over an invention for up to 20 years from filing in India. It is the strongest form of exclusivity, but you pay for it with disclosure: the full invention becomes public when the application is published.

Exclusive licences. You do not have to invent something to own the right to it. An exclusive licence from a university, lab or company gives you sole use in an agreed field and territory. It is often the fastest route to a defensible position, because the research has already been done.

Trade secrets. Recipes, process settings, supplier terms and code can be protected for as long as you keep them secret. India has no dedicated trade secret statute, so protection relies on contracts, access controls and the courts. It suits things that are hard to reverse-engineer from the product.

Proprietary data. Data you collect through your own operations, sensors or customers, and have the right to use, can train models and inform decisions no competitor can replicate. Its value depends on keeping it clean, consented and exclusive.

Regulatory approvals and certifications. A licence to manufacture a drug, a type approval for a device or a food safety certification takes time and evidence to earn. Until a competitor earns their own, you have the field.

Most durable positions combine several of these. A licensed patent protects the core idea, trade secrets protect how you make it well, and your own data shows you how to keep improving it.
