What does a patent actually cost in India? An honest breakdown.

Government fees are the small part. Drafting, examination and years of renewals are where the money goes. Real ranges for startups, institutions and companies.

Short answer

For a startup, individual or small entity, official government fees from filing to grant are usually under ₹15,000. Professional drafting and prosecution typically adds ₹40,000 to ₹2,00,000 depending on complexity. Large companies pay about five times the official fees. Always check the current schedule on the IP India website.

‘How much does a patent cost?’ is the question we hear most, and the answer people find online is usually either the government fee, which sounds suspiciously cheap, or a law firm's quote, which sounds alarming. Both are true. They are just different parts of the bill.

Part one: official fees

These are paid to the Patent Office and depend on who you are. Individuals, startups, small entities and educational institutions pay the lower rate. Everyone else pays roughly five times as much. For the lower rate, e-filing an application (Form 1) costs about ₹1,600, and requesting examination (Form 18) about ₹4,000. Expedited examination (Form 18A) costs more, and early publication (Form 9) is optional.

Watch for the extras. Each claim beyond ten and each page beyond thirty carries an additional fee, which is one reason good agents write tight specifications. Filing on paper instead of online also costs more.

Part two: professional fees

This is where the real range lives. Drafting a strong specification for a straightforward mechanical invention might cost ₹30,000 to ₹60,000. A complex chemical, biotech or software invention can run well past ₹1,50,000. Responding to the examination report and attending a hearing are usually billed separately.

It is tempting to save money here. Resist. The claims decide what your patent actually protects, and a cheaply drafted claim can leave you with a certificate on the wall and no way to stop a copier.

Part three: keeping it alive

Renewal fees start from the third year and rise over time, for up to twenty years. For a small entity they are modest in the early years. Recent rule changes also offer a discount for paying several years in advance online. Budget for renewals from the start: the most common way a good Indian patent dies is a missed payment.

Going abroad

If you plan to file in other countries, the numbers change completely. A PCT application and national filings in the US, Europe and a few Asian markets can easily cost several lakhs per country over the life of the patent, including translations and local agents. Decide within 12 months of your first filing which markets truly matter.

How startups pay less

DPIIT-recognised startups pay the lower official fees and can use the SIPP scheme, under which the government pays the professional fees of an empanelled facilitator. For an early-stage company, that can bring the full cost of an Indian patent down to little more than the official fees.
