How a startup can file a patent at a fraction of the cost
DPIIT recognition unlocks lower official fees, faster examination and government-paid professional help. How to use each, step by step.
1. Get DPIIT startup recognition
Apply on the Startup India portal. Recognition is free and usually quick, and it is the key that unlocks every concession that follows.
2. Claim the startup fee rate
When filing, declare your startup status and provide your recognition certificate. You then pay the reduced official fees, around 80 percent lower than a large entity.
3. Choose a SIPP facilitator
Under the Startups Intellectual Property Protection scheme, pick a facilitator from the government's empanelled list. Their professional fees for drafting and filing are paid by the government, not by you.
4. File a provisional to secure your date
If the product is still changing, file a provisional specification first. You have 12 months to file the complete specification with claims.
5. Request expedited examination
Startups can file Form 18A for expedited examination. Many applications on this route receive a first examination report within months, which helps when raising funds.
6. Plan renewals and foreign filing early
Before 12 months pass, decide whether to file abroad through the PCT. And set up renewal reminders: a lapsed patent is the most avoidable loss in IP.
